What, then, is the difference between confidentiality and secrecy? To put it simply, secrecy not only withholds certain facts from public knowledge, but also removes those facts from judicial oversight and potential sanctions. It creates a legal vacuum. [...] What we do need, however, is confidentiality, both in a diplomatic and in an individual sense. Diplomatic confidentiality creates a protected framework for negotiations, inspections and other confidence-building measures aimed at de-escalating tensions and maintaining or restoring a lawful situation. If this goal cannot be achieved within a reasonable time frame, then diplomatic confidentiality loses its justification and can easily turn into secrecy and complicity.

A much more convincing explanation for this stunted indictment was that the US wanted to avoid officially charging Assange with espionage, at least for the time being. Espionage being the classic example of a political offence, any such charge would have blocked Assange’s extradition under Article 4 of the Anglo-American extradition treaty of 2003, which expressly prohibits extraditions for political offences. The computer intrusion charge was sufficient to satisfy the requirement of ‘dual criminality’, according to which no person can be extradited unless the alleged offence constitutes a crime in both countries.
